1. Introduction

Northgate Law (“Northgate Law”, “we”, “us” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, store and protect personal information when you visit https://northgatelaw.ca/ (the “Website”), contact us, subscribe to our updates, or request legal services.

We handle personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), Ontario’s applicable legislation, and Canada’s Anti-Spam Legislation (CASL), as well as the confidentiality and professional obligations that apply to lawyers under the rules of the Law Society of Ontario.

By using this Website, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Website or submit personal information through it.

2. Who Is Responsible for Your Information

Northgate Law is responsible for the personal information it collects and controls. We have designated a Privacy Officer who is accountable for our compliance with this policy:

Privacy Officer: Vokhid Urinov

Mailing address: 67 Conarty Crescent, Whitby, Ontario L1P 0L3, Canada

3. Personal Information We Collect

We collect only the information we reasonably need for the purposes described in this policy.

3.1 Information you provide to us

When you complete our consultation form, email or call us, or subscribe to updates, you may provide:

  • Your first and last name
  • Email address and phone number
  • The area of law your enquiry relates to
  • Any details you include in your message (for example, a description of your tax, corporate, estate, litigation or debt matter)
  • Your preferences for communication and your consent records

If you become a client, we will collect additional information necessary to provide legal services, such as identification, financial and tax records, corporate documents, and other information relevant to your matter. That information is governed by our retainer agreement and our professional duties of confidentiality, in addition to this policy.

3.2 Information collected automatically

When you browse the Website, we and our service providers may automatically collect technical information, including:

  • IP address and approximate location
  • Browser type, device type and operating system
  • Pages visited, time spent, referring website and links clicked
  • Date and time of your visit

This information is collected through cookies and similar technologies (see Section 7).

3.3 Information we do not seek through the Website

Please do not send sensitive or confidential details about your legal matter (for example, tax returns, banking information, identification numbers or privileged information) through the website contact form or by unencrypted email before we have confirmed that you are a client or have agreed on a secure method of communication.

4. Important Notice: Sending Us a Message Does Not Create a Lawyer–Client Relationship

Submitting a form, emailing or calling us does not, by itself, create a lawyer–client relationship. Until we have confirmed in writing that we have agreed to act for you, information you send us may not be protected by solicitor–client privilege, although we will treat enquiries as confidential and handle them in accordance with this policy and our professional obligations. Please do not send time-sensitive material through the Website.

5. How We Use Your Information

We use personal information for the following purposes:

  • To respond to your enquiries and book consultations
  • To assess whether we can act for you, including conflict-of-interest checks required by law and professional rules
  • To provide legal services and manage our client relationship, including billing and collections
  • To send you newsletters, legal updates and articles, where you have consented (see Section 8)
  • To operate, secure, maintain and improve the Website and understand how visitors use it
  • To comply with legal, regulatory, professional and law society obligations, including anti-money laundering and record-keeping requirements
  • To protect our rights, detect and prevent fraud or misuse, and respond to legal claims

We will not use your personal information for a new purpose without notifying you and, where required, obtaining your consent.

We collect, use and disclose personal information with your knowledge and consent, except where the law permits or requires otherwise. Consent may be express (for example, ticking a box or submitting a form) or implied (for example, when you voluntarily contact us to request information about our services). You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer. Withdrawing consent may limit our ability to respond to you or provide certain services.

7. Cookies and Analytics

Our Website is built on WordPress and may use cookies, pixels, log files and similar technologies to make the site work, remember your preferences, and measure performance.

  • Essential cookies: needed for the Website to function and be secure.
  • Analytics cookies: help us understand how visitors use the Website (for example, through Google Analytics or similar tools). These tools may collect your IP address and usage data.
  • Marketing cookies: if enabled, used to measure the effectiveness of our advertising or show relevant content.

You can control or delete cookies through your browser settings. You can also use tools such as the Google Analytics opt-out browser add-on. Disabling cookies may affect how the Website works. [If you use a cookie consent banner, describe it here.]

8. Email Marketing and Anti-Spam (CASL)

We will only send you commercial electronic messages, such as newsletters and promotional emails, if you have given consent or where the law otherwise permits. Every such message will identify us, include our contact information and contain a working unsubscribe mechanism. You can unsubscribe at any time by clicking “unsubscribe” in any email or by contacting us at info@northgatelaw.ca. We will process unsubscribe requests without delay and in any event within 10 business days.

We may still contact you about legal services you have requested or about an existing client matter, as permitted by law.

9. Disclosure of Your Information

We do not sell your personal information. We may share it only in the following circumstances:

  • Service providers: trusted third parties that help us run our practice and Website, such as website hosting, IT and cybersecurity, email and form providers, analytics, cloud storage, accounting, and practice management software. They may only use the information to provide services to us and are required to protect it.
  • Professional advisers and others involved in your matter: where necessary for your file and with your consent or as permitted by law, for example accountants, experts, courts, tribunals, the Canada Revenue Agency, opposing parties or other counsel.
  • Legal and regulatory requirements: where required or permitted by law, such as to comply with a court order, subpoena, law society requirement or regulatory request, or to protect our rights or those of others.
  • Business transfers: if our practice is merged, restructured or transferred, in which case the information may be transferred subject to continued protection.

Where we act for a client, information is disclosed only as the client authorizes or as necessary to carry out the engagement, and subject to solicitor–client privilege and our duty of confidentiality.

10. Storage and Transfers Outside Canada

Some of our service providers (for example, cloud, email or analytics providers) may store or process information on servers located outside Canada, including in the United States. When your information is processed in another country, it may be subject to the laws of that country and may be accessible to its courts, law enforcement and national security authorities. We use contractual and other safeguards to require comparable protection. You may contact our Privacy Officer for further information about our practices regarding service providers outside Canada.

11. How We Protect Your Information

We use physical, organizational and technological safeguards appropriate to the sensitivity of the information, including secure hosting, access controls, encryption where appropriate, password protection and staff confidentiality obligations. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

If a breach of security safeguards involving your personal information creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada, and keep records of the breach, as required by law.

12. How Long We Keep Your Information

We keep personal information only as long as necessary for the purposes for which it was collected, or as required by law and professional rules. Website enquiries that do not lead to a retainer are kept for a limited period, after which they are securely deleted or anonymized. Client files are retained for the period required by the Law Society of Ontario, tax and corporate legislation and our retention policy [insert retention period, e.g. at least 7 to 10 years after the file closes], and are then securely destroyed.

13. Your Rights

Subject to applicable law, you have the right to:

  • Ask what personal information we hold about you and how it has been used and disclosed
  • Request access to your personal information
  • Ask us to correct inaccurate or incomplete information
  • Withdraw your consent to certain uses or disclosures
  • Challenge our compliance with this policy

To make a request, please contact our Privacy Officer using the details in Section 2. We may need to verify your identity and will respond within the time required by law (generally within 30 days). We may refuse or limit access in limited situations permitted by law, for example where information is protected by solicitor–client privilege, contains information about other individuals, or cannot be disclosed for legal reasons. If we refuse a request, we will explain why.

If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada (www.priv.gc.ca). Residents of certain provinces, such as Quebec, may also have additional rights under provincial privacy legislation.

The Website may contain links to third-party websites and social media platforms (for example, Facebook, X, YouTube, WhatsApp or Telegram). We do not control these sites and are not responsible for their privacy practices. We encourage you to read their privacy policies. Messages sent through messaging apps may not be secure, so please avoid sharing confidential details this way.

15. Children’s Privacy

Our Website and services are intended for adults and are not directed at children. We do not knowingly collect personal information from anyone under the age of 16 without the consent of a parent or guardian. If you believe a child has provided us with personal information, please contact us and we will delete it.

The information on the Website, including blog articles, is for general information only and is not legal advice. Reading it or contacting us does not create a lawyer–client relationship. Please consult a lawyer about your specific situation.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or the law. The updated version will be posted on this page with a new “Last updated” date. We encourage you to review it periodically. Where required, we will seek your consent to material changes.
